BOURNYS PRODUCTIONS

Introduction

This policy governs all products, services, commissions, digital assets, files, and content provided by Bournys Productions. By purchasing, downloading, receiving, commissioning, accessing, installing, or using any Bournys Productions product, you acknowledge that you have read, understood, and agreed to comply with this policy in full.

Ownership of Intellectual Property

All products supplied by Bournys Productions remain the sole intellectual property of Bournys Productions unless explicitly stated otherwise in a signed written agreement.

Purchasing a product grants a licence to use the product only. It does not transfer ownership, copyright, source files, trademarks, branding rights, intellectual property rights, or any other ownership rights.

All rights not expressly granted to customers remain reserved by Bournys Productions.

Licence Grant

Customers receive a limited, non-exclusive, non-transferable, and revocable licence to use purchased products for their intended purpose.

This licence is granted solely to the original purchaser and may not be transferred, assigned, sold, gifted, traded, shared, sublicensed, inherited, or otherwise provided to another individual or organisation without prior written permission from Bournys Productions.

Strict Prohibition on Resale & Redistribution

The following actions are strictly prohibited:

• Reselling products
• Redistributing products
• Leaking products
• Sharing files with third parties
• Uploading products to Discord servers
• Uploading products to websites
• Uploading products to repositories
• Uploading products to marketplaces
• Trading products
• Giving products away for free
• Bundling products with other assets
• Including products within asset packs
• Including products within development packs
• Distributing products through cloud storage services
• Transferring licence ownership without written permission

This restriction applies to all marketplace products, commissioned work, custom assets, scripts, models, textures, liveries, graphics, maps, systems, templates, and any other content supplied by Bournys Productions.

This prohibition applies regardless of whether money, Robux, services, products, assets, or any other form of compensation is exchanged.

Commissioned Products

Commissioned products are subject to the same restrictions as marketplace products unless otherwise agreed in writing.

Commissioning a product does not grant ownership of the intellectual property, source files, branding, redistribution rights, copyrights, or trademarks.

Bournys Productions reserves the right to reuse, modify, redistribute, resell, or otherwise commercialise commissioned work unless an exclusive agreement has been separately purchased and agreed to in writing.

Organisation & Team Usage

Products purchased by organisations, businesses, communities, roleplay groups, development teams, emergency service communities, or similar groups may only be used within that organisation.

Members, staff, volunteers, contractors, developers, or associates may not extract, copy, transfer, redistribute, leak, share, or otherwise distribute assets outside of the organisation.

Changes in ownership, management, administration, leadership, or development teams do not automatically transfer licence rights.

Licence Holder Responsibility

The licence holder is solely responsible for securing purchased assets, accounts, repositories, cloud storage services, development environments, backups, and team members.

Claims that a leak occurred through a friend, contractor, volunteer, staff member, team member, developer, or any other third party do not automatically exempt the licence holder from investigation.

If a product distributed to a licence holder is leaked, redistributed, or shared without authorisation, Bournys Productions reserves the right to hold the licence holder accountable unless sufficient evidence demonstrates that reasonable precautions were taken and the licence holder was not responsible.

Credits & Attribution

Credits, copyright notices, licence notices, ownership notices, branding, acknowledgements, and attribution information supplied by Bournys Productions must remain intact unless written permission has been granted.

Customers may not remove, alter, hide, replace, obscure, falsify, or modify ownership information associated with any Bournys Productions product.

Anti-Piracy & Asset Tracking

Bournys Productions reserves the right to implement watermarking, licence verification systems, anti-piracy technology, identification measures, asset tracking systems, and security mechanisms where legally permitted.

Attempts to disable, remove, bypass, reverse engineer, interfere with, or circumvent such systems may result in immediate licence termination and further enforcement action.

Investigation Rights

Bournys Productions reserves the right to investigate any suspected breach of this policy.

Customers may be required to provide information necessary to verify ownership, licence compliance, usage rights, or product distribution.

Failure to cooperate with an investigation may result in suspension or permanent termination of licences and services.

Enforcement Actions

Bournys Productions takes intellectual property protection seriously. Where a violation is identified, enforcement action may be taken without prior warning.

• Immediate licence revocation
• Removal of product access
• Permanent blacklisting
• Termination of customer accounts
• Removal from official communities
• Refusal of future services
• DMCA takedown notices
• Copyright infringement claims
• Contacting hosting providers
• Contacting platform operators
• Contacting payment providers
• Reporting violations to relevant services
• Pursuing legal remedies where appropriate

No Refunds for Violations

Customers found to be in breach of this policy are not entitled to refunds, compensation, replacements, credits, reimbursements, or any other form of financial recovery.

Revoked licences shall remain revoked regardless of previous payments made.

Limitation of Liability

All products are provided on an "AS IS" basis without warranty of any kind.

Bournys Productions shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or financial damages arising from the use or inability to use any product, including but not limited to data loss, game corruption, service disruption, platform changes, or loss of revenue.

Right to Modify

Bournys Productions reserves the right to amend, update, modify, replace, or remove any section of this policy at any time without prior notice.

Continued use of Bournys Productions products constitutes acceptance of any updated terms.

Acceptance of Terms

By purchasing, downloading, receiving, commissioning, accessing, installing, or using any Bournys Productions product, you acknowledge that you have read, understood, and agreed to comply with this policy.

Violation of this policy may result in immediate enforcement action without warning.
