Policies
Commission Resale Rights
Please be aware that Bournys Productions retains the right to resell any commission we create for you. When you purchase a commission, you are receiving a license to use the content, but we maintain ownership and may offer the same or similar products to other clients.
Turnaround Time
Standard commissions typically take 1-3 weeks depending on complexity. Rush orders may be available for an additional fee. We will provide you with an estimated completion date when your commission is confirmed.
Revisions
Each commission includes up to two rounds of minor revisions. Additional major changes may incur extra charges. We want you to be satisfied with the final product, so please communicate clearly about your requirements upfront.
Communication
We will keep you updated throughout the development process. You can expect regular progress updates and will have opportunities to provide feedback at key milestones.
File Delivery
Completed commissions will be delivered as Roblox-compatible files via the agreed-upon method, such as a Roblox model file or direct game integration. All necessary documentation and installation instructions will be included. Files will most likely be downloaded from a given URL.
Legal
Intellectual Property Rights
All commissioned work created by Bournys Productions remains the intellectual property of Bournys Productions. Upon full payment, the client receives a non-exclusive, perpetual license to use the commissioned content within their Roblox game(s).
Resale Rights
Bournys Productions explicitly reserves the right to resell, redistribute, or otherwise commercialize any commissioned work to other parties. The client acknowledges and agrees that commissioned content may be made available to other clients in identical or modified form.
Non-Exclusive License
The license granted to the client is non-exclusive. Bournys Productions may license the same or substantially similar content to multiple parties without restriction.
Mandatory Attribution
The client must maintain all credits, attribution notices, and license information provided by Bournys Productions within the commissioned product. This includes but is not limited to in-game credits, script headers, model descriptions, and any README or LICENSE files provided with the commission.
Prohibition on Removal
The client is strictly prohibited from removing, obscuring, or modifying any credits, copyright notices, or license information included with the commissioned work.
Consequences of Credit Removal
Removal, modification, or obscuration of credits, attribution, or license information constitutes a material breach of this agreement and will result in: - Immediate and automatic termination of the client's license to use the commissioned work - Forfeiture of all rights to the commissioned product - Obligation to immediately cease all use of the commissioned work - Potential legal action including DMCA takedown notices and copyright infringement claims - No refund of any fees paid
License Enforcement
Upon detection of credit removal or violation of attribution requirements, Bournys Productions reserves the right to pursue all available legal remedies including but not limited to DMCA takedown procedures, Roblox Terms of Service violations reporting, and civil litigation.
Payment Terms
Payment Schedule
Payment terms will be agreed upon before work commences. Typical payment structures include 50% upfront deposit with 50% due upon completion, or full payment upfront for smaller commissions.
Non-Refundable
Once work has commenced, all payments are non-refundable regardless of project completion status or client satisfaction, except in cases where Bournys Productions fails to deliver any work product.
Delivery Upon Payment
Final work products will only be delivered after full payment has been received and cleared.
Warranties and Disclaimers
No Warranty
Commissioned work is provided "AS IS" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
No Liability
Bournys Productions shall not be liable for any damages, including but not limited to direct, indirect, incidental, consequential, or punitive damages arising from the use or inability to use commissioned work, including but not limited to game corruption, data loss, revenue loss, or any other damages.
Client Responsibility
The client is solely responsible for testing commissioned work in their game environment and ensuring compatibility. Bournys Productions is not responsible for conflicts with other game systems, performance issues, or any negative impact on the client's game.
No Guarantee of Functionality
While Bournys Productions strives to deliver functional, working products, we do not guarantee that commissioned work will function perfectly in all environments or remain functional after Roblox platform updates.
Age Requirement
Clients must be at least 13 years of age or have explicit parental or guardian permission to commission work and enter into this agreement.
Accurate Information
Clients must provide accurate and complete information regarding commission requirements, contact information, and payment details.
Compliance with Platform Terms
Clients must ensure that their use of commissioned work complies with Roblox Terms of Service and Community Standards.
Prohibited Uses
Clients may not use commissioned work for any illegal purposes, to harass or harm others, or in violation of any applicable laws or platform policies.
Termination
Termination by Bournys Productions
Bournys Productions reserves the right to terminate any client's license immediately and without notice if the client violates any term of this agreement, particularly credit removal or attribution violations.
Effect of Termination
Upon termination, the client must immediately cease all use of commissioned work and remove it from all games and projects. No refund will be provided upon termination for cause.
Survival
Sections relating to ownership, warranties, disclaimers, and limitation of liability shall survive termination of this agreement.
Modification of Terms
Right to Modify
Bournys Productions reserves the right to modify these terms at any time. Modifications will apply to all future commissions and may apply to existing commissions at Bournys Productions' discretion.
Notice
Clients will be notified of material changes to these terms via the contact information provided during the commission process.
General Provisions
Entire Agreement
This document constitutes the entire agreement between Bournys Productions and the client regarding commissioned work and supersedes all prior agreements or understandings.
Severability
If any provision of this agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.
Governing Law
This agreement shall be governed by and construed in accordance with applicable laws, without regard to conflict of law provisions.
No Waiver
Failure by Bournys Productions to enforce any provision of this agreement shall not constitute a waiver of that provision or any other provision.
